PROMOTIONAL OFFER TERMS AND CONDITIONS

The following are the terms and conditions (the “Promotional Offer Terms”) governing the “Intel Ultrabook” Promotional Offer (the “Promotional Offer”) owned and operated by Rakuten.com Shopping (the “Company”) and offered to Rakuten.com Shopping customers (“Customer(s)”) who have a valid Rakuten.com Shopping Account (an “Account”). Creating an Account is free. This Promotional Offer is available only through the Company’s full desktop website and is not available to mobile users or through mobile applications.

By participating in the Promotional Offer, Customer(s) who have an Account earn promotional Rakuten Super Points™ (“Super Points”) by making a qualifying purchase of a selected Intel-powered ultrabook computer or other specified products through that Account subject to these Promotional Offer Terms and the Super Points terms and conditions. Checkout must be completed before the specified end time of the promotional period. Customer(s) who (1) make a qualifying purchase through their Account and then (2) enter the correct Code at checkout will be awarded a specified number of promotional instant Super Points for that product purchase. Purchases by guest users, resellers, exporters, wholesalers, any businesses of any kind for commercial resale, or any other customers for resale are not eligible under this Promotional Offer.

Customer(s) may be prompted and required to opt in or to enter the correct promotional code for their product purchase at checkout. The promotional Super Points that will be awarded in conjunction with that purchase are viewable at checkout. The Company reserves the right to void any award of Super Points associated with orders that do not completely follow these requirements. Any orders for which payment is made using PayPal Express, Google Checkout, V.me, MasterPass and/or any other external payment systems do not qualify for any Super Point promotions.

Any awards described in this Promotional Offer will be awarded in the form of promotional Super Points. All promotional Super Points earned during these promotions will be available fifteen (15) days after shipment and will expire forty five (45) days later. Expiration dates applicable to any Super Points held in a Customer(s) Account can be viewed on the Account page on the Company site. Promotional Super Points are offered as promotional items only and are void if sold for cash or other consideration, or if altered or copied. Promotional Super Points cannot be reissued if destroyed, lost, or stolen. Promotional Super Points have no intrinsic value, are not equivalent to cash, and may not be redeemed for cash. Promotional Super Points may not be purchased or sold by Customer(s) and the Company will not sell promotional Super Points. Promotional Super Points are the property of the Company and Customer(s) have no property rights or other legal interests in the promotional Super Points. Promotional Super Points are not valid where their earning or redemption or the associated promotion is prohibited by law.

If any item is returned by Customer(s) for refund, then the Company reserves the right to withhold from that refund dollar amount(s) that are equal to (1) the discount awarded through redemption of Super Points during the purchase of that item; and (2) the discount awarded through redemption of any standard Super Points or any promotional Super Points during the period between (a) the original redemption purchase for which products are being returned and (b) the date of such product return.

This Promotional Offer will start at 12:01 AM Pacific Time on April 8, 2013 and will terminate at 11:59 PM Pacific Time on June 30, 2013. The Company reserves the right, at its sole discretion and for any reason, to terminate all or any portion of this Promotional Offer by giving notice to that effect by means of a posting on the homepage and/or via another method of notice that may be deemed appropriate in the Company’s sole discretion. This Promotional Offer is open only to individuals eighteen (18) years or older at the time of purchase who are legal residents of the fifty (50) United States and District of Columbia. This Promotional Offer is limited to one (1) offer and award per person and one (1) offer and award per household. These promotional Super Points are subject to these Promotional Offer Terms. Any attempt to claim any associated promotional Super Points or continued use of an Account or participation in the Promotional Offer constitutes Customer’s consent and agreement to abide by the most current version of these Promotional Offer Terms and the Super Points terms and conditions. All federal, state and local laws and regulations apply. Void where prohibited by law.

Prices for all products sold by the Company or its marketplace merchant sellers are determined independently by the Company or such marketplace merchant sellers, as applicable. This Promotional Offer is for a limited time and is subject to product availability.
