The Rakuten Back to Relearning Math Giveaway (“Promotion”) is sponsored by Ebates Performance Marketing, Inc., d/b/a Rakuten Rewards (“Rakuten”), 160 Spear Street, Suite 1900, San Francisco, CA  94105 (“Sponsor”)

ELIGIBILITY: Open Only to Legal Residents OF THE fifty (50) UNITED STATES AND THE DISTRICT OF COLUMBIA, 18 years of age or older, WHO ARE RAKUTEN MEMBERS. ESTABLISHING A RAKUTEN ACCOUNT IS FREE. Void Where Prohibited. Employees (and their immediate families (spouse, and parents, children and siblings and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related) of Sponsor, its parent, affiliates, subsidiaries and advertising and promotion agencies are not eligible to enter or win. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and/or judges, which are binding and final on matters relating to this Promotion. Promotion is subject to all applicable federal, state and local laws.

HOW TO ENTER:  On August 17, 2021, beginning at or around 1:00 p.m. Pacific Time (“PT”) and ending at 11:59 p.m. PT or whenever the correct answer has been submitted on Instagram, whichever is sooner, there is one (1) way to enter. Instagram: Visit the Rakuten profile page on Instagram, find the post about the Promotion and comment with the answer to the math problem in the post. If you do not already do so, you must “follow” @Rakuten on Instagram to be eligible.

Entries generated by script, macro or other automated means or by any means which subvert the entry process are void. Limit one (1) entry per person.  Multiple entries will be void. Entries become the sole property of Sponsor.

If you do not have an Instagram account, establishing an account is free.  All Instagram terms apply (as applicable). Entrants must at all times comply with the www.Rakuten.com Terms and Conditions.

ENTRY REQUIREMENTS: Entry must be in keeping with Sponsor’s image & not be offensive or inappropriate, as determined by Sponsor in its sole discretion.  Entry must not defame or violate or infringe upon the rights of any person or entity. Sponsor reserves the right to disqualify any entry and remove any post that it determines, in its sole discretion, is not in compliance with these Official Rules.

WINNER DETERMINATION:  The first eligible entrant to comment on the Instagram post with the correct answer as determined by Sponsor in its sole discretion, will be deemed a potential winner. Odds of winning depend on the timing of entries and number of eligible entries received. Potential winner will be notified by direct message or @reply and will be asked to confirm that Sponsor may announce them as winners. If a prize or prize notification is returned as undeliverable, or a potential winner is not in compliance with these rules, prize will be forfeited and, at Sponsor’s discretion, an alternate winner selected.

PRIZE (1): $100 bonus to Rakuten account. Approximate retail Value of all prizes: $100. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. All federal, state and local taxes, if any, and all other costs and expenses associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the winners. Winners may not substitute, assign or transfer prize, but Sponsor reserves the right, at its sole discretion, to substitute a prize of comparable or greater value. All prize details are at Sponsor’s sole discretion. Limit one (1) prize per person.

GRANT OF RIGHTS:  By submitting an entry, each winner grants to Sponsor and its licensees, successors and assigns an irrevocable, perpetual, unlimited, royalty-free, fully paid-up license to reproduce, distribute, display, exhibit, exploit, perform, edit, create derivatives of, and otherwise use the entry and all elements of such entry, together with any other material, and the name, user name, city and state of residence, voice, image and/or likeness of entrant (including, but not limited to, applicable profile photo), in any and all media now known or hereafter devised, in any manner, in whole or in part, worldwide, without compensation or notification to, or permission from, winner or any third party, for any purpose whatsoever, including without limitation, for purposes of advertising or trade.

GENERAL CONDITIONS: Entrants, by participating, agree that Sponsor, Instagram, Facebook, Inc. and their respective parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of prize or participation in this Promotion. Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered or garbled entries or email; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of entries, the announcement of the prize(s) or in any Promotion-related materials.  Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion.  Released Parties are not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Promotion or downloading materials from or use of the website.  Persons who tamper with or abuse any aspect of the Promotion or website or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void.  Should any portion of the Promotion be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Promotion and, if terminated, at its discretion, select the potential winner(s) from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor.
